1. Introduction
This Privacy Policy describes how Virtton ("we", "us", "our") collects, uses, discloses, and protects personal information in connection with the Virtton mobile application (the "App"). The policy applies to users located in the United States.
2. Information We Collect
We collect information necessary to provide and improve the App, including: • Account information: username, email address • Uploaded photos you submit for virtual try-on processing • Virtual try-on results and content you choose to share • Device and usage information: device type, operating system, IP address, crash reports, analytics • Transaction and affiliate event data (clicks that lead to affiliate links) Photos uploaded for try-on are processed temporarily and are not retained permanently, except as described below.
3. How We Use Information
We use collected information to: • Provide and operate virtual try-on services • Display your try-on results within the App and community features • Improve, analyze, and personalize the App • Process affiliate link events and analytics • Comply with legal obligations
4. Third-Party Processing & fal.ai
We use third-party AI providers (currently fal.ai APIs) to process uploaded photos and produce virtual try-on images. Uploaded photos are transmitted to these providers for processing and are deleted in accordance with our retention rules. We do not use uploaded photos to train third-party models without explicit consent. Please refer to fal.ai's privacy terms for additional details.
5. Data Retention
We retain data only as long as necessary for the purposes described: • Uploaded photos: deleted from our servers and third-party processors automatically after processing completes (typically within 60 seconds, never longer than 24 hours) • Try-on results: stored up to 180 days unless you delete them earlier • Account information: retained while your account is active • Analytics data: retained for up to 24 months If you request deletion, we will remove your data in accordance with applicable laws and our procedures.
6. Biometric Data and State Notices (BIPA, Texas, Washington)
Our AI processes images to detect face position, body shape, and pose for try-on functionality. We may extract biometric-like measurements that are used only to enable fitting and are not used for identification or authentication. For residents of Illinois, Texas, and Washington: we comply with applicable biometric privacy laws. We do not sell biometric data and we delete such data immediately after processing (within the retention periods stated above).
7. Data Sharing and Sales
We do not sell personal information. We may share or disclose information with: • Service providers who help operate the App (hosting, analytics, AI providers) • Affiliate networks to record click or purchase events • Legal authorities when required by law California residents: you may exercise your rights under the CCPA/CPRA (see section on Your Rights).
8. Your Rights (CCPA/CPRA & General)
Depending on your jurisdiction, you may have rights including: • Right to access the personal information we hold about you • Right to request deletion of your personal information • Right to correct inaccurate information • Right to opt-out of the sale of personal information (we do not sell personal information) • Right to data portability To exercise these rights, contact info@virtton.com or use in-app support. We will respond in accordance with applicable law.
9. Cookies and Tracking
We and our service providers use cookies, mobile identifiers, and similar technologies for analytics, troubleshooting, advertising measurement, and to remember user preferences.
10. Security
We implement commercially reasonable technical, administrative, and physical safeguards to protect personal information. However, no security measures are perfect or impenetrable.
11. DMCA and Copyright
If you believe content in the App infringes your copyright, send a DMCA takedown notice to our designated agent. Include identification of the work, the infringing location in the App, your contact information, and a statement of good-faith belief. Email: info@virtton.com
12. International Transfers
Data processed via third-party services (including fal.ai) may be transferred to servers outside your country. By using the App, you consent to such transfers.
13. Changes to this Privacy Policy
We may update this Privacy Policy. Material changes will be communicated via the App or by email where required. Continued use after notice constitutes acceptance.
